1. Acceptance of Terms

By accessing or using x-n.dev ("the Platform"), operated by bxng.com ("we", "us", or "our"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform.

2. Description of Service

x-n.dev is a platform that enables users to compare and evaluate the performance of AI models side by side — including large language models (LLM), speech-to-text (STT), and text-to-speech (TTS) providers. Users define test scenarios, configure use cases with prompts, audio files, and parameters, and run arenas where multiple AI models process the same inputs in parallel for comparison.

The Platform does not provide AI model inference directly. Users must supply their own API keys from third-party providers (e.g., OpenAI, Anthropic, Google, Deepgram, ElevenLabs, Cartesia, and others) to use the comparison features.

3. Accounts and Registration

You must create an account to use the Platform. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are solely responsible for all activity that occurs under your account.

You may register using email and password or through supported third-party authentication providers (e.g., Google). By using third-party login, you authorize us to access limited profile information (name and email) as provided by that service.

4. API Keys and Third-Party Services

You are solely responsible for obtaining and managing API keys from third-party AI providers. x-n.dev stores your API keys encrypted and uses them exclusively to make requests on your behalf during arena runs.

We are not responsible for any charges, rate limits, usage policies, or terms imposed by third-party providers. You must comply with the terms of service of each provider whose API keys you use on the Platform.

5. Plans and Billing

The Platform operates on paid subscription plans processed through Stripe, Inc. Paid plans may include a 7-day trial when offered at checkout.

• Pro ($19/month): includes plan limits for active scenarios, active arenas, simultaneous arenas, and members.
• Business ($79/month): includes higher plan limits for teams evaluating models before production decisions.
• Provider costs: model usage costs are billed directly by third-party providers through your own API keys and are not included in the x-n.dev subscription.
• Pricing currency: pricing may be displayed in USD or BRL depending on your region. Amounts are converted at checkout via Stripe, Inc.
• Subscription cancellations: cancellations take effect at the end of the current billing cycle unless Stripe or x-n.dev explicitly indicates otherwise. Subscription payments are non-refundable unless required by applicable law or at our discretion.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful or prohibited purpose.
• Submit prompts, audio, or scenarios containing illegal, harmful, or abusive content.
• Attempt to reverse-engineer, disassemble, or compromise the Platform's security.
• Share your account credentials with unauthorized third parties.
• Use automated tools to scrape, crawl, or interfere with the Platform.
• Attempt to circumvent run limits, plan restrictions, or other platform controls.

7. Usage Limits

To ensure fair access and platform stability, we apply operational limits including but not limited to: the number of arenas that can run simultaneously per organization, the size of uploaded audio files, the number of models per arena, and the number of members per workspace. These limits vary by plan and may change over time. Current limits are shown in the Platform interface.

8. Audio Retention

Audio files generated or uploaded during arena runs are retained for a period that depends on your plan: 30 days for Pro and 90 days for Business. After this period, audio files are automatically deleted. Text results and metadata are retained for as long as your account is active.

9. User Content

You retain ownership of all content you create on the Platform, including scenarios, prompts, audio files, and arena configurations. By using the Platform, you grant us a limited, non-exclusive license to store and process your content solely for the purpose of providing the service.

We do not sell, share, or use your content for training AI models or for any purpose beyond service delivery.

10. Organizations and Collaboration

The Platform supports multi-tenant workspaces ("Organizations"). Organization owners and admins are responsible for managing members, permissions, and subscription settings for the workspace. We are not liable for actions taken by members within your organization.

11. Availability and Modifications

We strive to maintain continuous availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice.

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

12. Limitation of Liability

To the maximum extent permitted by law, x-n.dev and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of runs, loss of profits, or service interruption, arising from your use of the Platform.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We are not responsible for the output quality, accuracy, or behavior of any third-party AI model accessed through the Platform.

13. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in activities that may harm the Platform or other users. You may delete your account at any time through your organization settings.
